although not a required test as in most other Florida counties, radon gas is the second highest cause of lung cancer deaths in the country. One in every 15 homes has a high level of radon most people are not aware of. A radon test requires a small machine to be left in the home for two days while all door and windows remain closed. This will determine the level of radon gas in the home. If the result is over 4 pCi/L, radon is evident. Levels higher than 4 pCi/L are considered 35 times higher than what is allowed by the Nuclear Regulatory Commission.
This is a serious problem in our indoor environment as we live in air-conditioned closed-up homes. In order for the radon to dissipate, homes need to be better ventilated with doors and windows opened daily. However, the good news is there are systems that can be installed to remediate the radon, keep the air moving, and provide cleaner and circulating air.<br />
<br />
MA: What are some of the other ways you protect your clients from in-home environmental hazards?<br />
<br />
RH: The other inspection I am adamant in doing is a complete<a href="http://funguyinspections.com/real-estate-mold-inspection/" target="_blank"> mold inspection</a>. No matter how new the home is, good indoor air quality is a must. Since we spend at least 12 hours per day in our homes, we must be vigilant about any apparent moisture, visible or not. Mold can be caused by A/C and roof leaks, wet drywall, especially from windows, and shower area moisture which, if not treated, can cause spores to grow. Once these spores disperse, they will infiltrate many areas in the home. But once again, we are able to remediate mold by removing the drywall and replacing the areas with new, non-toxic barriers for good indoor air quality and safe for living environments.
LEED Standards are becoming crucial, as well as environmentally safe products are paramount to buyers of today. I am proud to say, I am a resource for all things green regarding home building and home renovating as I resourced it for my own home. I am knowledgeable on the best non-toxic paint, best non-toxic drywall and non-formaldehyde cabinetry and flooring. I am a believer in non-toxic landscape fertilizer and weed killers that will not harm our children and environment. I am also profoundly committed to the best detergents and home cleaning supplies that will not affect our skin and body. Last but not least, I believe all homes should have a good water purifying system. That is mandatory on my list.<br />

MA: What are some of the benefits saltwater pools offer over chlorine pools?<br />
<br />
RH: Hair! All kidding aside, chlorine/Clorox is not only bad for our hair but our bodies. A salt water chlorination system facilitates a process that prevents damage to our skin and lungs. This is a much better alternative to today’s chlorine pools. and caused a truck to explode. That caused more trucks to explode. Over
30 explosions followed. Huge amounts of chemicals spilled into a large
creek that flows directly into the Ohio River. About <a href="http://www.ohioincidentresponse.com/go/doc/5635/2198001/" target="_blank">175 personnel</a> were involved in working on the response.<br />
Official reports indicate that no one was hurt or killed in the accident.<br />
But in the nearby creek, 70,000 fish died.<br />
The creek feeds directly into the Ohio River.<br />
The Ohio River provides a lot of people with drinking water.<br />

What chemicals?<img alt="gas-fracking-explosion-ohio" height="173" src="http://www.actio.net/tasks/sites/default/assets/Image/images_blog/fracking-explosion-ohio.jpg" style="float: right; height: 173px; margin: 6px; width: 230px;" width="230" /></h5>
The key question: what chemicals were dumped into the river, what
chemicals killed all the fish almost instantly and were those chemicals
safe for human drinking water just a short way downstream? No one knew.
For almost a week, the EPA could not tell the public to not drink the
water because it was unknown what chemicals had been dumped.<br />
The risk to humans in the hours and days following the spill is
unknown. Some say the risk will never be known, because too much time
passed between event and knowing what to test for.<br />
All because there is no law or protocol for disclosing such
information to EPA. Not just in Ohio. This same thing could happen in <a href="http://switchboard.nrdc.org/blogs/amall/new_nrdc_analysis_state_fracki.html" target="_blank">most states</a>.<br />
Local water authorities, the private company hired to monitor water
contamination, and area residents did not get a full rundown of
chemicals, even after the EPA and the Ohio EPA finally received the
information, a full five days after the explosions occurred, reports the
<a href="http://www.dispatch.com/content/stories/local/2014/07/21/details-on-chemicals-trickle-in-after-spill.html" target="_blank">Columbus Dispatch</a>.<br />
Here's where we get into tricky areas of disclosure.<br />
<h6>
State laws explode</h6>
State laws govern whether and to whom a company like Halliburton has
to disclose its onsite chemicals in the event of an emergency. Many
states, like Ohio, want to make drilling for oil and gas more attractive
to industry, to bring money and jobs into the area.<br />
So Ohio state laws, for example, don't require Halliburton to
disclose to the Environmental Protection Agency anything about
"proprietary ingredients" in a fracking fluid — even in the event of an
emergency, even if those ingredients are chemicals which can kill fish
or harm humans.<br />
<h6>
What chemicals are in fracking fluid?</h6>
Fracking fluid is used by <a href="http://www.dispatch.com/content/stories/local/2014/07/21/details-on-chemicals-trickle-in-after-spill.html" target="_blank">drilling companies</a>
to fracture bedrock in order access underground honey-combed gas
repositories. Fracking fluid is a water-based fluid that expands when
injected into rock, thus causing a fissure where gas can be accessed
with drilling and storage gear.<img alt="fracking-accident-ohio" height="235" src="http://www.actio.net/tasks/sites/default/assets/Image/images_blog/p6160716.jpg" style="float: right; height: 235px; margin: 6px; width: 320px;" width="320" /><br />
Fracking fluid is water-based, but considering its function it will
be no surprise that the fluid quite necessarily contains notable amounts
of hazardous substances such as:<br />
<ol>
<li>ethylene glycol (human kidney risk) </li>
<li>formaldehyde (known carcinogen) </li>
<li>naphthalene (possible carcinogen)</li>
</ol>
And that's not including proprietary ingredients.<br />
<h6>
Why not disclose?</h6>
Companies have no desire to share information with EPA in the event of an emergency. For many reasons:<br />
<ol>
<li>On principle</li>
<li>An aversion to setting a precedent of disclosure</li>
<li>To protect information from prying (competitive and the uninformed public's) eyes</li>
<li>Concern that admitting to vats of, say, formaldehyde on site would incite audits and undesirable disclosure inquiries</li>
<li>And let's face it, companies often don't know exactly what <a href="http://www.actio.net/default/index.cfm/products/regulator/" target="_blank">chemical inventory</a> they've got and where the inventory is located <span style="font-family: 'Times New Roman'; font-size: small; font-style: normal; font-variant: normal; line-height: 17.77777862548828px;">—</span>
especially once a chunk of inventory has exploded — you can't tell what
was there by going over and reading at the label when it's not there
anymore; this is a chemical inventory fail, all too common</li>
</ol>
<h6>
Here is Halliburton's side:</h6>
<blockquote>
"We don't know why U.S. EPA and Ohio EPA didn’t have the information
prior to July 3," Halliburton spokeswoman Susie McMichael told Mother
Jones magazine. "If they had asked us earlier, we would have provided
the information, consistent with our standard practice."<br />
The Ohio EPA, on the other hand, maintains that ODNR, emergency
workers, and federal and state EPA officials had a representative ask
Statoil [the site's owner] and Halliburton [the contractor] for a
complete list of chemicals just after the spill. Several days later,
environmental regulators pressed for the information again and learned
that it had already been shared with only ODNR, which according to the

What really happened there in terms of <a href="http://en.wikipedia.org/wiki/Material_Disclosure" target="_blank">disclosure</a>? Who knows. She said / he said. A full investigation will take some time.<br />
What we do know is that a major explosion occured on a drilling site,
and the public and environment probably were not well informed or
protected in its aftermath. 70,000 dead fish would agree.<br />
<h6>
Looking ahead</h6>
While total material disclosure may not be a realistic or even
desirable goal, in the event of an emergency, it's reasonable that
protection agencies should have access to information such as, "What

Sen. Charles Schumer (D-NY) and county leaders are asking the U.S.
Department of Housing and Urban Development to prepare plans that will
assist homeowners remediate the hazardous mold<br />
once Congress approves

victims,rendering houses unhealthy and unlivable even after the water
has been pumped out,” said Schumer during a news conference Tuesday.Federal Emergency Management Agency resources cannot be used to
remove mold from houses entirely under current law, only mold up to the
watermark from the flooding, the senator said. He said the Sandy aid
package working its way through Congress should remedy that, but that
immediate aid is crucial.<br />
“The longer we wait, the longer these homes lie vacant,” said Schumer
at the Seaford home of Larry Elliott, 85, who is among the homeowners
in dire need of financial assistance for mold remediation.<br />
Elliott’s home, which he had lived in for 30 years until being
displaced by Sandy, is right on canals that lead to the Seaford Harbor.
Once able to look out onto the canals while sitting on his bedroom
windowsill, he returned to a house that is inhabitable despite having
heat and electricity restored because mold has infested the structural
beams.<br />
“The damage is devastating,” said Elliott. “I can hardly remember
where the entrances are anymore,” he added while standing in what was
left of one of the bedrooms of the house.<br />
The mold has spread in other Sandy-flooded houses like Elliot’s. Ten
percent of 948,540 of LI households experienced some flooding or storm
damage, according to FEMA.<br />
The damp surfaces combined with the heat being turned back on create
the ideal environment for mold to grow. The Centers for Disease Control
and Prevention warns that exposure to some forms of mold can pose health
risks such as upper respiratory tract symptoms and eye and skin
irritation.<br />
“Mold is not a minor issue,” said Schumer. “Many houses that have been flooded have or will have mold.”<br />
Mold remediation can cost thousands of dollars, a costly service many
residents can’t afford, forcing them to live in toxic homes, turn to
cheaper ineffective products or find someplace else to live.<br />
Schumer, who was joined by Nassau County Executive Ed Mangano and Sam
Chu, commissioner for the Suffolk County Department of Labor, are also
urging lawmakers to reimburse programs such as AmeriCorps that have been
funding mold remediation.<br />
In the past, federal funding was able to aid Hurricane Katrina
victims with mold removal through the Community Development Block Grant
Disaster Recovery.<br />
Congress approved more than $9 billion in Sandy aid to the national
flood insurance program last week after the House of Representatives
failed to approve the full $60 billion package that had passed the U.S.
Senate, sparking local outrage. Despite the delays, Elliot is staying
positive.<br />
“I am hopeful,” Elliott told the <i>Press</i>. “I can’t help but be hopeful after this outpouring support today that I will be able to get the aid I need.”<br />

Consumer Reports begin testing dozens of home air purifiers that promise cleaner air and easier breathing. Consumer Reports also provided tips on <a name='more'></a> improving air quality indoors.<br /><br />On average, $500 million per year is spent on air purifiers, and the results indicate that purchasing the most expensive machine is not always the best. there are many types of air filters, including a standard filters, electrostatic and HEPA filters.<br /><br />The researchers tested each of the filters in a sealed room with clay dust and cigarette smoke. Using a particle analyzer, the researchers measured how much of the contaminants had been removed from the air.<br /><br />The LightAir model, which costs $300, "was about as effective at removing smoke and dust as using no air cleaner at all," said Consumer Reports' Bob Markovich. The two huge steam generators at Unit 2, each containing 9,700 tubes, were replaced in fall 2009, and a year later in its twin plant, Unit 3, as part of a $670 million overhaul.</p><p>According to the Nuclear Regulatory Commission, more than a third of the wall had been worn away in two tubes at Unit 2, which will require them to be plugged and taken out of service. At least 20 percent of the tube wall was worn away in 69 other tubes, and in more than 800, the thinning was at least 10 percent.</p><p> “The amount of wear that we are seeing on these tubes is unusual for a new steam generator,” NRC spokesman Victor Dricks said. “If you have that kind of thinning anywhere along the length of the tube, you have a problem because it degrades the integrity of the tube, which can contribute to leaks.”</p><span id="mn_Article"><p>Owner Southern California Edison disputes the figures released and says a tiny amount of radiation could have escaped into the atmosphere but no one was endangered.<br /></p><p>The utility also has found unusual, premature wear found on hundreds of similar tubes in a twin reactor called Unit 2. You can improve your indoor air by following a few tips:<a name='more'></a><br /><br />1. Clean underfoot - avoid carpeting that absorbs much of the dirt, dust and allergens. Try to select hard wood surfaces, tile or laminate flooring. These surfaces are much easier to clean.<br /><br />2. Keep furniture and windows dust free. Dirt may not always be visible on the surface, but it is usually there. Leather and vinyl furniture is easier to clean than upholstered furniture. Putting a slip cover over fabrics will help in routine maintenance throughout the year.<br /><br />3. Curtains and blinds trap more than incoming light. Take them down and wash them with a garden hose or a vacuum. This will help reduce the chances of mold growing on or new the window or window's shades surfaces.<br /><br />4. Consider using a HEPA filter. This is the best way to reduce indoor allergens and other particulates from the air. HEPA stands for High Efficiency Particulate Arrest and is capable of removing 99.97% of dust and allergens from the air.<br /><br />5. Use a HEPA vacuum to remove the dust and debris from the floors and the furniture within your home. Most vacuums capture a small amount of the dust and debris and redistribute the remaining debris back into the air. "This new testing is compelling because it underscores the importance of hand and surface hygiene. Most cold and flu viruses are spread because people touch surfaces in their immediate area and then touch their faces, other objects and other people. Washing and drying your hands frequently throughout the day, can help prevent your risk of getting sick or spreading illness around the office."<br /><br />It seems there is such a thing as over doing it when it comes to hygiene. Studies have shown that too much cleanliness maybe linked to a poorer immune system. Called the hygiene hypothesis, the more sterile environment can lead to higher rates of illness because our bodies forget the everyday germs.<br /><br />"A study published in a 2002 issue of JAMA concluded that children living in a house with two or more dogs or cats during their first year of life were much less likely to develop allergic diseases compared with children raised without pets. <br /> </span> <p style="margin: 0in 0in 0pt;">The mere presence of mold spores at a property is not a sufficient basis for expert testimony on the medical effects of exposure to mold. Pervasive errors in the chain of custody of mold samples render scientific testimony based upon such samples inherently unreliable.</p> <p style="margin: 0in 0in 0pt;"> </p> <p style="margin: 0in 0in 0pt;">The California Court of Appeal, Second Appellate District, Division Six has certified for publication an important decision which may have significant impact on the conduct of mold litigation nationwide. In <i>Geffcken v. D'Andrea, et al.,</i> (2d Civil No. B176232), a case in which Lane E. Webb (Partner-San Diego) was lead trial counsel and co-appellate counsel, the Court held that the mere presence of mold spores at a property is not a sufficient basis for expert testimony on the medical effects of exposure to mold. Instead, plaintiffs are required to first establish the presence of mycotoxins. In addition, the Court held that pervasive errors in the chain of custody of mold samples render scientific testimony based upon such samples inherently unreliable.</p> <p style="margin: 0in 0in 0pt;"> </p> <p style="margin: 0in 0in 0pt;">In <i>Geffcken</i>, Eva Geffcken (Eva) and her son, Alexander Geffcken (Alexander), claimed that they were exposed to mold mycotoxins at their residence. Eva also claimed that she was exposed to mold mycotoxins at her place of work, Casa Dorinda, where she worked as a caregiver for one of the residents. Respondents allegedly were responsible for the management, maintenance, or construction of the properties. A global demand of $6 million was made to settle the case.</p> <p style="margin: 0in 0in 0pt;"> </p> <p style="margin: 0in 0in 0pt;">Eva and Alexander maintained that the exposure caused them to suffer from various ailments which, in the case of Eva, included lung cancer; neurological problems; respiratory problems; immune deficiency; fibromyalgia; infections on her tongue, toenails, and skin; chronic fatigue; weakness; memory loss and headaches and in the case of Alexander, included chronic fatigue, immune dysfunction, neurological problems, respiratory problems, reactive airway disease, elevated liver enzymes and chemical hepatitis of the liver. Eva and Alexander's expert witness on the medical effects of exposure to mold was Dr. Gary Ordog. Patrick Moffett was the Geffcken's mold sampling expert but significantly, he did not test for the presence of mycotoxins.</p> <p style="margin: 0in 0in 0pt;"> </p> <p style="margin: 0in 0in 0pt;">The trial court conducted a hearing under Evidence Code section 402 which lasted two weeks in Department 6 of the Santa Barbara Superior Court, the Honorable Denise deBellefeuille, presiding, on the joint motions in limine filed by Respondents. Those motions, which Mr. Webb took the lead in arguing on behalf of Respondents, were the following: (1) to exclude the testimony of Dr. Gary Ordog; (2) to exclude the environmental sampling data of Patrick Moffett; (3) to exclude the results of two medical tests: a mycotoxin antibody test and a blood serology test, and (4) to preclude Appellants from alleging exposure to mycotoxins at the properties in question. In addition to Dr. Ordog and Mr. Moffett, the court heard testimony from a Dr. Aristo Vojani as a proponent of one of the blood serology tests as well as from Respondents' experts, Daniel Baxter (mold sampling), Dr. Daniel Sudakin (medical toxicology), and Dr. Adrian Casillas (internal medicine, allergy and immunology). Following the hearing, the trial court granted Respondents' motions in limine and entered judgment in favor of Respondents. The Court of Appeal affirmed the judgment of the trial court. Mr. Webb and Alan E. Greenberg (Associate-San Diego) handled the appeal on behalf of Respondent Montecito Retirement Association dba Casa Dorinda.</p> <p style="margin: 0in 0in 0pt;"> </p> <p style="margin: 0in 0in 0pt;">The <i>Geffcken</i> Court first addressed the trial court's exclusion of Patrick Moffett's environmental sampling data. The Court noted that Mr. Moffett's data had little, if any, probative value because of the "pervasive chain of custody errors and deficiencies" noted by Daniel Baxter which invalidated the integrity of the sampling results. Moreover, the Court held that, in any event, the probative value of Moffett's data was minimal and properly excluded under California Evidence Code section 352 because, at most, it showed that mold spores, not mycotoxins, were present at Appellants' residence and at Casa Dorinda.</p> <p style="margin: 0in 0in 0pt;"> </p> <p style="margin: 0in 0in 0pt;">The <i>Geffcken</i> Court noted that the issue was not whether mold spores had been present at Appellants' residence and at Casa Dorinda. The issue was whether Appellants had been exposed to mycotoxins at these properties, and whether the mycotoxins had caused the various ailments from which they allegedly suffered. The Court agreed with authoritative publications from the Environmental Protection Agency and the American College of Occupational and Departmental Medicine that the presence of mold in a building does not necessarily mean that mycotoxins are present. The Court also agreed with the testimony provided by Dr. Sudakin that no valid conclusion about mycotoxins as the cause of health effects can be derived from limited environmental testing data and that an attempt must be made to quantify exposure [to mycotoxins] and dose.</p> <p style="margin: 0in 0in 0pt;"> </p> <p style="margin: 0in 0in 0pt;">The <i>Geffcken</i> Court next addressed the issue of the trial court's exclusion of the Immunosciences Mycotoxin Antibody Test (Immunosciences Test) and the IBT Blood Serology Test (IBT Test). The Immunosciences Test purports to show the presence of antibodies produced by the presence of mycotoxins. The IBT test purports to show the presence of antibodies produced by the actual mold, rather than to mycotoxins. The blood serology test results were positive for both Appellants. The Court concluded, primarily based upon the testimony of Dr. Sudakin and Dr. Casillas, as well as a publication from the California Department of Health Services, that neither the Immunosciences Test nor the IBT Test had gained general acceptance in the relevant scientific community and therefore did not satisfy the <i>Kelly-Frye</i> test which is used in California. Unfortunately, in a footnote added by the Court at the time it certified the opinion for publication, the Court stated that under a different set of facts its holdings would not preclude a trial court from ruling that the required <i>Kelly-Frye</i> foundation had been met for the admission of the Immunosciences Test and the IBT Test. Nonetheless, the <i>Geffcken </i>opinion provides some support for the exclusion of the Immunosciences Test and IBT Test in other cases in the absence of any additional evidence than was presented at the 402 hearing or evidence that the tests have gained general acceptance in the relevant scientific community since the date of the opinion.</p> <p style="margin: 0in 0in 0pt;"> </p> <p style="margin: 0in 0in 0pt;">Since Mr. Moffett's environmental sampling data and the two blood serology tests were properly excluded from evidence by the trial court and, in the absence of any testing for mycotoxins at the properties in question, the Court held that the trial court was correct in precluding Appellants from alleging exposure to mycotoxins at the properties.</p> <p style="margin: 0in 0in 0pt;"> </p> <p style="margin: 0in 0in 0pt;">Finally, with respect to Dr. Ordog, the Court did not need to address the significant evidence presented at the 402 hearing concerning the questionable nature of Dr. Ordog's credentials or whether he properly qualified as an expert on the subject of adverse health effects caused by exposure to mycotoxins.
